EMBARK Distribution & Publishing sells music by encouraging MP3 file trading and Internet radio. EMBARK allows consumers to freely download and listen to music worldwide.
Assignment of Exclusive Rights by the Record Label. The artist gives EMBARK Distribution & Publishing exclusive rights, title, and interest in and to the following property, for distribution and marketing commercial exploitation in the Territory:The artist waives as against the Company the benefits of any and all moral rights and agrees not to assert any moral rights against the Company relating to the Recordings delivered under this distribution and or marketing:
a. the Songs and artwork; and codes
b. the Artist’s performance of the Songs contained in the Recording,and lyrics
c. the title of the Recording.
. . License of Name and Image.
The artist grants EMBARK Distribution & Publishing and to parties authorized by the Company the following perpetual rights: upon the timely occurrence and performance of all material and obligations required to distribute, the artist shall grant to EMBARK Distribution & Publishing . the permission to use the Artists name, the Artist’s photographic image, for purposes of distribution and marketing.
a. the right to use and publish the Artist’s name, likeness, and biographical material for advertising purposes in connection with the recording in distribution and marketing.
b. the right to present, distribute, license, or otherwise use within the Territory the Recording made under this Agreement including the right to combine and sell with recordings of performances of other artists; and
c. the right to perform the Recordings publicly.
COPYRIGHT. The Artists will maintain 100% of copyrights.
CONTRIBUTION BY ARTIST. The artist agrees to fully cooperate with the EMBARK Distribution & Publishing, in good faith, in the distribution and promotion.
MUSIC SUBMISSION:The artist will submit a single cover with the company logo. The artist is responsible for making sure the data submitted on “Distribution Profile Form” is correct..The Distribution catalog will include:
Release catalog(submit title, label name codes, and release type).
Submit cover artwork (1400 x1400 pixel.).
Submit Stereo Formats: AIF, AIFF, FLAC, MP3, M4A, OGG Or WAV, up to 192kHz, 16-bit, 24-bit.
Submission of Track details (lyrics, features, etc).
Social outlets submission.
ROYALTIES. All distribution royalties (100%) are owned by the artist. If EMBARK Distribution & Publishing publishes a catalog release their percentage of royalties will be( 20%).
